Welcome to Ortho Analyser. By accessing our website, creating an account, or using our services, you accept these Terms and Conditions of Use (TCU). If you do not agree to them, please do not use our services.
How we handle personal data is described separately in our Privacy Policy and Cookie Policy.
1. Purpose
These TCU govern access to and use of the Ortho Analyser platform, a tool for orthodontists and other dental professionals covering radiographic, photographic and 3D analysis, and the monitoring of their patients' treatment progress. They set out the rights and obligations of users and of Ortho Analyser, an independent business established in Switzerland ("Ortho Analyser", "we", "us"). 2. Who May Use the Service
The platform is intended for healthcare professionals, particularly orthodontists.
Two routes of access exist:
- Registered accounts. Full access to the platform requires a user account. You are responsible for the confidentiality of your credentials and for any activity conducted through your account. If your credentials are lost or stolen, you must inform us immediately.
- Guest analyses. A single analysis may be run without an account by providing an email address. Guest use is subject to these TCU. You must be entitled to upload the image you submit, and we ask that you remove patient-identifying detail from it where you can.
3. Registration and Account Creation
When registering, you must provide accurate and complete information. We reserve the right to suspend or terminate any account in the case of false information or non-compliance with these TCU.
4. Pricing, Payment and Refunds
Prices are shown on the website in the currency indicated, and are exclusive of any taxes that may apply in your jurisdiction.
- Analysis packs are one-off purchases granting a fixed number of analyses. They do not expire and do not renew automatically.
- Unlimited subscriptions renew automatically for successive periods until cancelled.
Payments are processed by Stripe. We do not receive or store your card details.
Purchases of analysis packs are final once analyses have been used. If a technical fault on our side prevents an analysis you have paid for from completing, contact us at contact@ortho-analyser.com and we will credit or refund it.
5. Use of Patient Data
You commit to submitting only the patient data strictly necessary for the analysis requested. The personal data collected includes first name, last name, gender and date of birth, together with the imaging you upload.
For patient data uploaded through a professional account, you are the data controller and we act as your processor, processing that data only on your instructions. You are responsible for having a lawful basis for the processing and for informing your patients. A Data Processing Agreement under Article 28 GDPR is available on request at contact@ortho-analyser.com.
Images, radiographs and 3D models are protected using current security standards. You acknowledge that no system can eliminate risk entirely.
6. Platform Features
The Ortho Analyser platform offers the following features:
- Radiographic Analysis: Tool for analyzing dental radiographs with automatic landmark detection.
- Photographic Analysis: Tool for analyzing intraoral and facial photographs for a comprehensive evaluation.
- 3D Analysis: Integration of 3D models enabling detailed and precise visualization of dental and facial structures.
- Treatment Monitoring: Personalized tracking of patients' progress throughout orthodontic treatments.
- Secure Online Access: Online access compliant with current security standards to protect sensitive data.
Diagnostic Assistance Only
Ortho Analyser is a digital platform designed to assist healthcare professionals in analyzing orthodontic data. The tool provides values and measurements calculated from user-provided data. These are generated as an aid and do not replace clinical evaluation by a qualified practitioner. The values obtained may contain inaccuracies or errors, and should never be interpreted as an autonomous diagnosis or a definitive clinical recommendation. The orthodontist remains solely responsible for verifying and interpreting the information generated by the platform.
Clinician Responsibility
Users are fully responsible for the use and interpretation of the data produced. Practitioners must carefully examine, verify and, if necessary, supplement the values and results provided by the application with additional clinical examinations before making a diagnosis or prescribing treatment. Ortho Analyser disclaims liability for measurement or calculation errors and their consequences, to the extent permitted by law.
Support Tool, Not a Medical Device
Ortho Analyser is designed to support orthodontists in organizing and analyzing data related to their patients' examinations. It is not intended, marketed or validated as a medical device, and is not designed for establishing diagnoses or recommending treatments. It must not be used as the sole basis for any clinical decision.
7. Termination and Data Export
You may cancel a subscription at any time. Cancellation takes effect at the end of the current billing period; the subscription is not renewed thereafter, and periods already paid for are not refunded on a pro-rata basis.
You may close your account at any time. Following closure you have 90 days to export your data, which is downloadable in PDF format. After that period the data is permanently deleted.
We may suspend or terminate an account for non-compliance with these TCU, giving you a reasonable opportunity to export your data except where immediate suspension is necessary to protect the service or third parties.
8. Intellectual Property
All content on the Ortho Analyser platform, including software, designs, texts, graphics, logos and databases, is the exclusive property of Ortho Analyser or its partners. Any reproduction, distribution, modification or unauthorized use is strictly prohibited.
Data and images you upload remain yours. We claim no ownership over them and use them only to provide the service.
9. Security and Data Protection
Data security is a priority for Ortho Analyser. We use current security technologies and protocols to protect your data and your patients' data. You acknowledge that no system can eliminate risk entirely, and agree to submit data responsibly.
10. Limitation of Liability
To the extent permitted by law, we disclaim liability for:
- Technical issues preventing access to the platform,
- Loss or corruption of data,
- Inappropriate or illegal use of the platform by users.
We shall not be held liable for indirect, special or consequential damages arising from use of the platform.
Nothing in these TCU excludes or limits liability for death or personal injury, for gross negligence or wilful misconduct, or for any other liability that cannot lawfully be excluded.
11. Software Updates
To ensure platform security and performance, we perform regular software and security updates. Certain features may be temporarily unavailable during these updates. We minimize interruptions and inform users if prolonged downtime is necessary.
12. Use of APIs and External Services
Certain platform features integrate external services or APIs, subject to the specific terms of each provider. We disclaim liability for the functionality or potential malfunction of these services, to the extent permitted by law.
13. Changes to the TCU
We reserve the right to modify these TCU. Users will be notified of significant changes by email or platform notification, and the "Last Updated" date above will change. Continued use of the platform after modifications signifies acceptance of the new TCU.
14. Governing Law and Jurisdiction
These TCU are governed by Swiss law. In case of dispute, the courts of the Canton of Vaud, Switzerland, shall have jurisdiction, unless otherwise required by mandatory provisions of the law applicable to you.
15. Regulatory Compliance
We comply with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection.
Account data, patient data and uploaded images are stored on servers in the European Union. Certain service providers, including our payment processor, are established outside Europe; those transfers are covered by appropriate safeguards. Full detail is in our Privacy Policy.
