Welcome to Orthoanalyser. By accessing our website and using our services, you fully and unreservedly accept these Terms and Conditions of Use (TCU). If you do not agree to these terms, you must cease using our services and website immediately.

1. Purpose

These TCU govern the access and use of the Orthoanalyser platform, a tool dedicated to orthodontists for radiographic, photographic, 3D analysis, and the monitoring of their patients' treatment progress. These TCU specify the rights and obligations of users and ortho-analyser.com ("the Company"), a Swiss company.

2. Access to the Service

Access to the platform is reserved for healthcare professionals, particularly orthodontists, after creating a user account. You are responsible for the confidentiality of your login credentials and any activity conducted through your account. In case of loss or theft of your credentials, you must inform us immediately.

3. Registration and Account Creation

When registering, the user must provide accurate and complete information. The Company reserves the right to suspend or terminate any account in case of false information or non-compliance with these TCU.

4. Use of Patient Data

Users commit to submitting only the patient data strictly necessary for analysis on the platform. The personal data collected includes: first name, last name, gender, and date of birth. Images, radiographs, and 3D models are protected according to the latest security standards. However, users acknowledge that zero risk cannot be guaranteed. Users are responsible for submitting data securely and complying with legal obligations regarding the protection of personal data.

5. Platform Features

The Orthoanalyser platform offers the following features:

  • Radiographic Analysis: Tool for analyzing dental radiographs with automatic landmark detection.
  • Photographic Analysis: Tool for analyzing intraoral and facial photographs for a comprehensive evaluation.
  • 3D Analysis: Integration of 3D models enabling detailed and precise visualization of dental and facial structures.
  • Treatment Monitoring: Personalized tracking of patients' progress throughout orthodontic treatments.
  • Secure Online Access: Online access compliant with current security standards to protect sensitive data.

Diagnostic Assistance Only

OrthoAnalyser is a digital platform designed to assist healthcare professionals in analyzing orthodontic data. The tool provides values and measurements calculated from user-provided data. However, it is essential to note that these are generated as an aid and do not replace clinical evaluation by a qualified practitioner. The values obtained via OrthoAnalyser may contain inaccuracies or errors. They should never be interpreted as an autonomous diagnosis or definitive clinical recommendation. The orthodontist remains solely responsible for verifying and interpreting the information generated by the platform.

Clinician Responsibility

Users of OrthoAnalyser are fully responsible for the use and interpretation of the data produced. Practitioners must carefully examine, verify, and, if necessary, supplement the values and results provided by the application with additional clinical examinations before making a diagnosis or prescribing treatment. OrthoAnalyser disclaims all liability for potential measurement or calculation errors and their consequences.

Support Tool and Non-Medical Device

OrthoAnalyser is a platform designed to support orthodontists in organizing and analyzing data related to their patients' examinations. As a management and data interpretation aid tool, OrthoAnalyser does not meet the legal and regulatory criteria for medical devices and is not designed, marketed, or validated for establishing diagnoses or recommending treatments.

6. Termination

Subscription termination can be done at any time with three months' notice. Users are responsible for retrieving their data before the end of their subscription. Data will be downloadable in PDF format during this period. Afterward, data will be permanently deleted.

7. Intellectual Property

All content on the Orthoanalyser platform, including software, designs, texts, graphics, logos, and databases, is the exclusive property of the Company or its partners. Any reproduction, distribution, modification, or unauthorized use is strictly prohibited.

8. Security and Data Protection

Data security is a priority for Orthoanalyser. We use the latest security technologies and protocols to protect your data and your patients' data. However, users acknowledge that zero risk cannot be guaranteed and agree to submit data responsibly.

9. Limitation of Liability

The Company disclaims liability for:

  • Technical issues preventing access to the platform,
  • Loss or corruption of data,
  • Inappropriate or illegal use of the platform by users.

The Company shall not be held liable for indirect, special, or consequential damages arising from platform use.

10. Software Updates

To ensure platform security and performance, OrthoAnalyser performs regular software and security updates. Users accept that certain features may be temporarily unavailable during these updates. The Company minimizes interruptions and informs users if prolonged downtime is necessary.

11. Use of APIs and External Services

Certain platform features integrate external services or APIs, subject to the specific terms of each provider. The Company disclaims liability for functionality or potential malfunctions of these services.

12. Changes to the TCU

The Company reserves the right to modify these TCU at any time. Users will be notified of changes via email or platform notifications. Changes take effect upon publication. Continued use of the platform after modifications signifies acceptance of the new TCU.

13. Jurisdiction and Governing Law

These TCU are governed by Swiss law. In case of disputes, the courts of the Company's registered office shall have jurisdiction, unless otherwise required by mandatory provisions.

14. Regulatory Compliance

OrthoAnalyser complies with applicable data protection laws, including the General Data Protection Regulation (GDPR) in Europe and its Swiss equivalents. The platform ensures that all user and patient data is stored on secure servers located in the EU or Switzerland, per legal requirements.
